Please read the following important terms and conditions before you register to the Site (the “Site”) or access any of the digital content available on the Site. By checking the box marked “I agree to the Terms and Conditions and Privacy Policy.” and clicking the “Create Account” button, you agree to be bound by the terms and conditions of this contract.
It is therefore important that you carefully read and ensure that you understand the terms set out within it. If you do not agree to the terms of this contract, please do not check the box “I agree to the Terms and Conditions and Privacy Policy.” Please note that unless you agree to the terms of this contract, you will not be able to register to become a member of the Rehabilitation Community.
These are the terms and conditions on which you may register to access the Site for the communication, networking and learning opportunities (the “Rehabilitation Community Digital Content”) provided by us through the Site. These terms and conditions also apply to your right as part of such membership to connect with other registered rehabilitation professionals through the Site and member-led groups.
Please read these terms carefully before you register to the Site. These terms tell you who we are, how we may change the contract, how you and we may end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
When you subscribe to the Site, you will also be required to agree to be legally bound by:

If we have to contact you we will do so by writing to you at the email address you provided to us as part of your membership application to the Site.
When we use the words “writing” or “written” in these terms, this includes emails.
Our acceptance of your application to register to the Site will take place when we email you to accept it, at which point a contract will come into existence between you and us.
We reserve the right to refuse to accept your membership application. If we do not accept your membership application, we will inform you of this in writing. Refusal may be because your conduct with respect to services we have provided to you previously has been unprofessional, or for other valid reasons.
We may update the Rehabilitation Community Digital Content and make changes to the Rehabilitation Community Services:
We will also add new Rehabilitation Community Digital Content, as well as removing old or out-of-date Rehabilitation Community Digital Content, from time to time, so as to keep the Rehabilitation Community Services current.
You are responsible for obtaining and maintaining all computer hardware and software needed to access and use the Rehabilitation Community digital platform. The Rehabilitation Community Digital content is best viewed by using of one of the following browsers:
You may access the Rehabilitation Community Services as soon as we accept your membership application (see clause 3.1) until the earlier of: (i) expiry of the membership Period; (ii) until you end the membership as described in clause 11; or (iii) until we end the membership by written notice to you as described in clause 12.
If access to the Rehabilitation Community Services is delayed or unavailable by an event outside our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event.
We may need certain information from you so that we can provide the Rehabilitation Community Services to you, for example, your name and email address. If so, this will have been stated when you apply for a membership to the Site. We will contact you in writing to ask for this information. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may end the membership. We will not be responsible for not providing the Rehabilitation Community Services if this is caused by you not giving us the information we need within a reasonable time of us asking for it.
We may have to suspend the provision of the the Rehabilitation Community Services and/or access to certain Rehabilitation Community Digital Content to:
We will contact you in advance to tell you we will be suspending the Rehabilitation Community Services, unless the problem is urgent or an emergency.
When you view and access the Rehabilitation Community Digital Content, you will have the right to use it (as set out in these terms), but you will not own it. We give you permission to use it (also known as a ‘license’) as set out in this clause 8 and for the purpose of you using and enjoying it according to these terms.
The Rehabilitation Community Digital Content:
Except where you have permission to use the Rehabilitation Community Digital Content under this clause 8, you will not obtain any rights of ownership or other rights (of whatever nature) in the Rehabilitation Community Digital Content.
As part of your Rehabilitation Community registration, you may use the Rehabilitation Community Services. From time to time, users may post content that you consider to be offensive, inappropriate or indecent. We do not have control over content that is posted by our users, however, if you do see any such content, please report this to us by email at [email protected] and we will review the content and if, in our discretion, we believe that it breaches the terms of the contract with such user or may affect our reputation, we will remove such content.
We are not responsible for the accuracy of any content posted by users.
You agree that you are responsible for any communication and other interaction between yourself and other users.
You agree not to upload any content that is, or could be considered:
You agree that you will keep your account login details secret and will not share them with anyone else.
To end the membership with us, please do the following:
We may end the membership at any time by writing to you if you breach these terms and conditions or the Terms of Service, in which case we will notify you in writing of the breach and require that you undertake specific remedial steps within the time period specified in the notice.
We may write to you to let you know that we are going to stop providing the Rehabilitation Community Services. We will let you know at least 24 hours in advance of our stopping the Rehabilitation Community Services.

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the registration process.
This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation.
If defective digital content which we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable skill and care, we will either repair the damage or pay you compensation.
If defective digital content which we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage which was caused by you failing to have in place minimum system requirements advised by us.
We only supply the Rehabilitation Community Services for domestic and private use. If you use the Rehabilitation Community Services for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We will only use your personal information in accordance with our Privacy Policy and Cookie Policy
We may transfer our rights and obligations under these terms to another organisation. We will contact you to let you know if we plan to do this.
You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.
This contract is between you and us. No other person shall have any rights to enforce any of its terms.
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts, however, if you live outside of England, this does not affect your right to any mandatory law which applies in the country in which you live.
The Rehabilitation Community (“we”, “us”, “our” or “the Rehabilitation Community”) is committed to protecting and respecting your privacy. This policy, together with our Terms and Conditions (and any other documents referred to in them), sets out the basis on which any personal information we collect, or that you provide to us, will be processed by us. Please read the following carefully.
By using the Rehabilitation Community, community.physio-pedia.com (the “Site”) and/or sharing personal information on the Rehabilitation Community and its community of users, you are accepting and consenting to the practices described in this policy.
For the purposes of the EU General Data Protection Regulation 2016 (the “GDPR”) the data controller is Physiopedia Plus Ltd, trading as Plus Ltd (company number 07878211), with a registered address at 10 Queen Street Place, London, England, EC4R 1BE.
For definitions of terms used in this Privacy Policy and the FAQs, see Section 20. Any terms not defined in this Privacy Policy have the meaning given to them in the Terms and Conditions.
This privacy policy pertains to the use of the Site, and (i) the information and materials made available on the Site (the “Rehabilitation Community Content”); and (ii) the related Rehabilitation Community services, (collectively, the “Rehabilitation Community Service”), and covers how the Rehabilitation Community treats personal information that it collects and receives from its users.
This Privacy Policy is incorporated into and is subject to the Rehabilitation Community Terms and Conditions. Your use of the Site, the Rehabilitation Community Content, the Rehabilitation Community Service and any information you provide on the Site is subject to the terms of this Privacy Policy and the Rehabilitation Community Terms and Conditions.
This Privacy Policy applies only to the Rehabilitation Community Services and any other related websites and services. The Rehabilitation Community does not exercise control over third party websites linked to or from within the Site. These third party sites may place their own cookies or other files on your computer or other device, collect data or solicit information from you. You are encouraged to read their privacy policies before you enter into an exchange with them.
The Rehabilitation Community uses technology to send, directly to your browser, the advertisements and links that appear on the Site. The Rehabilitation Community automatically receives your IP address when this happens. The Rehabilitation Community may also use other technologies (such as cookies, JavaScript, or web beacons) to measure the effectiveness of the advertisements and to personalise the advertising content (including pop-up adverts) to a certain audience.

The information the Rehabilitation Community collects is set out in this section 3.1. Failure to provide such information may mean that you are unable to receive the Rehabilitation Community Services or register as a Member.
You do not need to register for a Rehabilitation Community account in order to visit the Site, however, you must subscribe to use the Rehabilitation Community Service. For these no-registration-required services the Rehabilitation Community collects the following information:
To the extent that you submit to us any personal information belonging to third parties, you warrant that you have the consent of that third party to submit such data to us, including for such uses described in this Privacy Policy.
In order to use the Site content you must subscribe as a Rehabilitation Community “Member” (see the Terms and Conditions). The Rehabilitation Community collects the personal information described above at Section 3.1 from Members, and in addition, collects the following types of personal information from Members for the following purposes:

Sharing of information between the Rehabilitation Community companies
If you subscribe to the Rehabilitation Community Services, information (both personal and non-personal information) is shared between Physiopedia Plus Ltd and the Rehabilitation Community in order for Physiopedia and the Rehabilitation Community to provide or improve services.
Operations and maintenance contractors
The Site is hosted by Kinsta which provides processing and storage resources for operating the Site. Kinsta has staff based outside the EEA, and is certified under the EU-US Privacy Shield framework. Advertising and Promotions
The Rehabilitation Community may share non-personal information (such as anonymous website use data) with third-parties to assist them in understanding the Site, including usage of the Site and the services the Rehabilitation Community provides and the success of advertisements and promotions.
The Rehabilitation Community E-mail Newsletter
We use a third party provider, Sendy, to deliver our Rehabilitation Community email newsletter. We gather statistics around email opening and clicks using industry standard technologies including clear gifs to help us monitor and improve our content. Legal Requirements
If the Rehabilitation Community is under a duty to disclose or share your personal information in order to comply with any legal obligations, in order to enforce or apply our Terms and Conditions and other agreements; or to protect the rights, property, or safety of the Rehabilitation Community and its users or others.
Breach of the Rehabilitation Community Terms
the Rehabilitation Community also reserves the right to disclose collected Information that the Rehabilitation Community believes is appropriate or necessary to enforce the Rehabilitation Community Terms and Conditions, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Site, and to exercise or protect the rights, property, or personal safety of the Rehabilitation Community users or others.
Other
In the event that the Rehabilitation Community is acquired by or merged with a third party entity, the Rehabilitation Community reserves the right to transfer or assign the information the Rehabilitation Community has collected from you as part of such merger, acquisition, sale, or other change of control. If the Rehabilitation Community is involved in a change of control the Rehabilitation Community will provide notice before personal information becomes subject to a different privacy policy.
In the unlikely event of Physiopedia Plus Ltd bankruptcy, insolvency, reorganisation, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, the Physiopedia Plus Ltd may not be able to control how your personal information is treated, transferred, or used.
Except as described in this Privacy Policy, the Rehabilitation Community will not share your personal information with third parties unless you have elected to “opt-in” to such sharing of your information.

When you register as a Member, the Rehabilitation Community asks you to provide us with certain personal information. If the Rehabilitation Community wants to use your personal information for purposes other than those described in this Policy, the Rehabilitation Community will provide you with an effective way to opt-in to such use.

You can decline to submit personal information to the Rehabilitation Community, in which case you will not be able to participate as a Member.
The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA“). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers, including Kinsta. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.
All information you provide to us is stored on our secure servers. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our Site, you are responsible for keeping this password confidential, We ask you not to share a password with anyone.
Unfortunately, the transmission of information via the internet is not completely secure.
Although the Rehabilitation Community does its best to protect your personal information, we cannot guarantee the security of your data transmitted to our Site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.
We will store your personal information:
For as long as the Member’s profile remains active, unless you ask us to remove it; and
Only for such period as it is required to provide the services to you.
You may update your personal information or prevent or restrict processing of your personal information by visiting your profile page or contacting us at [email protected].
Data protection Legislation gives you the right to access information held about you, and related information including the purposes for processing the personal information, the recipients or categories of recipients with whom the personal information has been shared, where possible, the period for which the personal information will be stored, the source of the personal information, and the existence of any automated decision making. Your right of access can be exercised in accordance with such legislation. You can exercise your rights free of charge, but we reserve the right to charge a reasonable fee for such requests which are repetitive, manifestly unfounded or excessive, in accordance with applicable law.
Under certain circumstances, you can request transfer of your personal information directly to a third party where this is technically feasible.
The “Delete Account” option accessed from your Account Settings allows you to delete all personal information relating to you from the Site and our database. We will honour your request provided the personal information is not required for compliance with a legal obligation under European or member state law or for the establishment, exercise or defence of a legal claim.
If you have a complaint or problem or would like any personal information relating to you corrected or deleted, please contact us at [email protected]. We will forward your complaint, problem or request to the appropriate internal Physiopedia Plus Ltd department for a response or resolution. Personal information will be corrected or deleted, as applicable as soon as possible following receipt of the request. We try to answer every email within 2 business days, but may not always be able to do so.

We will notify you within 30 days of receipt of your letter to confirm your personal identifiers have been corrected or removed.
You may also lodge a complaint with the UK Information Commissioner’s Office (https://ico.org.uk/).
Upon your request, we will delete your personal information from our active databases and where feasible from our back-up media. You should be aware that it may not be technologically possible to remove each and every record of the information you have provided to the Rehabilitation Community from our servers, and this action will prevent the Member from downloading activity data following the deletion of their data. We may also retain personal information that is required for compliance with a legal obligation under European or member state law or for the establishment, exercise or defence of a legal claim. We will inform you if personal information is retained for this purpose.
In the event of a data breach we will endeavour to alert all affected Members within 72 hours after we become aware of the full details of the data breach.
Protecting the privacy of young children is especially important. No part of the Rehabilitation Community Site is directed to persons under 16. If you are under 16 years of age, then please do not use or access the Site at any time or in any manner. The Rehabilitation Community does not knowingly collect personal information on the Site from persons under 18 years of age.
The Site is hosted in the United Kingdom and is intended for and directed to users in the United Kingdom. If you are accessing the Site from the United States, Asia, or any other region with laws or regulations governing personal information collection, use, and disclosure that differ from the laws of England and Wales, please be advised that through your continued use of the Site, which is governed by English law, this Privacy Policy, and the Rehabilitation Community Terms and Conditions, you are transferring your personal information to England and you consent to that transfer.
This Privacy Policy may change from time to time. The Rehabilitation Community will post those changes on this page and, if the changes are significant, the Rehabilitation Community will provide a prominent notice. Please revisit this page frequently to stay aware of any material changes.

the Rehabilitation Community defines “personal information” as information that enables us to identify you directly or indirectly
The Rehabilitation Community defines “non-personal information” as information which does not identify individuals, whether on its own or in conjunction with other information collected by the Rehabilitation Community. This includes information that is collected from many people, anonymised and aggregated into groups so that individual users cannot be identified.
The Rehabilitation Community defines “collected information” as both the personal and non-personal information that the Rehabilitation Community collects from users.
“Opt-in” means you are actively indicating your preference to participate in a program, email, feature, tool, or enhancement on a web site. Typically, if you “Opt-in” you must provide certain information, usually Personal Information, to the website or otherwise actively indicate your choice or preference to participate in the website program.
“Opt-out” means that if you do not take some action you are indicating your preference to participate in a program, email, feature, tool or enhancement on a website. Typically, if you “opt-out” you must uncheck a box next to a stated preference or otherwise take some indicate action to indicate your preference not to participate in a program.
In order for you to use the Rehabilitation Community Services, the Rehabilitation Community needs to be able to authenticate you and protect your preferences and personal information from unauthorised access. To do that, the Rehabilitation Community asks that you sign up for a unique account, typically secured by your unique email address, a password and your name. No account information is shared with anyone other than the Rehabilitation Community except as specified in the Privacy Policy or with your consent.
